NOTICE OF BOARD VOTE AND CHAIRMAN STATEMENT
Plaintiff files this Notice to apprise the Court that, at the meeting of the Kennedy Center
Board of Trustees (“Board”) held on September 15, 2026, the Board voted to approve the closure
resolution. Thereafter, the Chairman of the Board issued a statement about the vote on social
media, indicating that the “closing will take place immediately, however, the Renovation and
Reconstruction, which is a very large and complex job, cannot begin until such time as the D.C.
Circuit rules on the Board’s approved name.” A screen shot of that statement appears below.
